Q: In a situation where the General Staff of the I.D.F. makes a decision forcing soldiers to transgress halacha, is there a mitzvah to serve in the army? Is it proper to sign the petition not to enlist in the army until the issue is straightened out?

A: It is a great mitzvah to serve in the army for the purpose of defending the nation and the Land, a mitzvah which is equal to all the other mitzvoth combined, for two reasons. First, anyone who saves a life is regarded as having saved an entire world (Mishna Sanhedrin 4:5), all the more so when dealing with saving the lives of the entire Jewish nation from their enemies. Second, the mitzvah of settling the Land of Israel, of which serving in the army is an important component, is equal to all the other mitzvoth (Sifrei, Re'i, parsha 53).

Therefore, it is a mitzvah to enlist in the army, and when a soldier receives an order which contradicts halacha, he should refuse to obey. (Rambam, Laws of Kings 3:9). Nevertheless, in extreme cases, there is room to consider a temporary postponement of enlisting, with the intention of rectifying the situation, as the Sages said in regards to Moshe Rabbeinu breaking the tablets – "Sometimes the cancellation of the Torah, is its' foundation" (Talmud Menachot 99b).

In practice, a large number of men from the Haredi sector and 'ba'alei teshuva' (newly religious) do not enlist, figuring that it is impossible to fulfill the mitzvoth properly in the army, and a decision similar to that of the General Staff, will likely strengthen this trend significantly. Consequently, on rare occasions there is room to consider postponing enlistment, so as to ultimately bolster recruitment. Has the time come for such a protest? I'm not sure. In every protest, there is room to weigh the advantages and disadvantages.

In any case, the high road is to enlist into the I.D.F. in order to defend the nation and the Land, and yet, to refuse orders that contradict halacha.

One thing is clear: It is incumbent upon the public leaders to do their utmost to publicly cancel the shameful decision of the General Staff, which was passed without any noticeable protest from the I.D.F. Rabbinate. Our great fear is that the public leaders will not act properly, and even obscure the public outcry, thus thwarting its impact, and in the end, the stain of this disgraceful decision forcing soldiers to transgress halacha will stick to the I.D.F., and the numbers of those abstaining from enlisting will increase.

It seems to be an oversight to declare that the "IDF defends the nation and the Land". In reality the IDF defends only the State of which it is the army of. It seems to be even bigger of an oversight to declare that the IDF is a tool in "settling the Land of Israel". As it happens the IDF is the only official army in the world at present that lets itself be used to destroy Jewish housing, because it is Jewish or synagogues, because they are places of Jewish worship or entire Jewish communities for the same, inadmissible, anti-Jewish, anti-Torah, G-d denying evil reason. In the light of this it indeed seems to be a sin to serve the IDF and to swear in to serve any non-Torah institution involved in the hastening of the anti-divine plan: We swore in in Sinai, for all generations! Jews therefore simply have to serve Hashem, not replacement, non-Torah entities, like the Zionist State. We are created to be Hashem-ists, not Buddhists, xtians or Zionists. The fact that Hashem blesses the State and its IDF (because it fights [some] of Israel's wars) does not mean we as ordinary Jews should or can or allowed to or authorized to do the same as He, for we are Jews, commanded not to deviate from Torah! How do you know Melamed that this State is not a Golden Calf State and its army is not a Golden Calf army? If it was just that, aren't we warned not to dance around it?!

צריכים אנו לחזור לדברי הרמב"ם (הל' עבודה זרה, סוף פרק עשירי) הקובע שאין לתת לשום גוי לגור ביננו עד שיקבל עליו ז' מצוות בני נח. וברור ברמב"ם (הלכות מאכלות אסורות, פרק יא הלכה ז) שאמנם הישמעאלים אינם מוגדרים כעובדי עבודה זרה. אבל הנוצרים הם בהחלט נחשבים עובדי עבודה זרה.

B"H - We read in Parashat Vayishlah of the angel that attacked Yaakob Abinu as he made his way back to Eretz Yisrael from the home of Laban. The Rabbis teach us that this angel was Satan himself. Every nation has a heavenly angel that advocates on its behalf, so-to-speak, in the heavens. Satan “volunteered” for the job of being the angel of the nation established by Esav, which represents evil and the antithesis of everything that Am Yisrael is meant to represent. Satan’s attack on Yaakob Abinu was launched in order to prevent Yaakob Abinu from establishing Am Yisrael, the nation that would, for all eternity, struggle against the evil of Esav. Fortunately, Yaakob Abinu won this battle, and although he was injured, symbolizing a diminution of Am Yisrael’s power, nevertheless, he triumphed over Satan and indeed we, his descendants, are still able to wage this struggle against the evil spiritual forces in the world.

Rav Elhanan Wasserman (1874-1941) raised the question of why Satan waited until the emergence of the third of our patriarchs before launching this assault. Why did he not try to attack Abraham Abinu, who founded the nation that was destined to be Satan’s nemesis? Wouldn’t it have been wiser for Satan to try to “nip it in the bud,” to cut off Am Yisrael at its very root, the moment Abraham Abinu came onto the scene? And even if, for whatever reason, Satan deemed it unwise to launch this assault against Abraham, why did he not attack during the time of Yishak? Why did he wait until the time of Yaakob?

Rav Wasserman answered this question by analyzing the particular points of strength of the three patriarchs. They were all towering spiritual figures, but each had his own “specialty,” his unique forte, if you will. Abraham excelled especially in the area of Hesed, loving kindness. But although he bequeathed this quality to his descendants, and Am Yisrael has always distinguished itself through its generosity, charity is not a uniquely Jewish quality. Many gentiles are also selfless and giving, as are many non-observant and unaffiliated Jews. Satan did not launch his attack against Abraham, because a nation that is defined primarily by Hesed is not guaranteed to endure. He did not feel threatened by Abraham, because a nation built mainly around loving-kindness, as important as this quality certainly is, will not likely last.

Yishak, too, did not pose an immediate risk to Satan. Yishak, who was offered as a sacrifice, signifies the quality of prayer (which is associated with sacrifices). Prayer, like Hesed, is a crucial aspect of religious life, but does not guarantee Am Yisrael’s survival. Many synagogues here in the United States and elsewhere were unable to continue past the first generation after their establishment. Satan did not feel threatened by Yishak because he knew that praying is not enough to produce another loyal generation of God-fearing Jews.

Yaakob Abinu, however, posed a grave threat to Satan. Yaakob is described as a “Yosheb Ohalim” (“tent-dweller”), a devoted student of Torah. His outstanding quality was Torah learning. Once Yaakob came onto the scene, Satan realized he was in trouble. A nation that devotes itself to learning and education is guaranteed to endure. If there are yeshivot where children are trained and educated to follow the nation’s laws, values and customs, the nation will continue to reproduce itself, generation after generation. And this is why Satan launched an attack against Yaakob. Seeing Yaakob’s commitment to Torah, Satan realized that Yaakob is indeed capable of producing an eternal nation that will hinder his attempts to promote evil. He therefore attacked Yaakob, and although he succeeded in inflicting an injury, making it more difficult for Yaakob and his descendants to fulfill their mission in the world, Yaakob prevailed.

Needless to say, every aspect of Judaism is critically important and may not be ignored. But we can learn from Satan that Torah education is what holds the key to Jewish survival. Satan can handle packed synagogues on Shabbat and charity events, but Torah learning is his kryptonite. It is our greatest weapon against him.

In nature there is a process called photosynthesis which is vital for life. Plants receive energy from the sun, and they process this energy in order to produce oxygen. Without this process, of course, we would not be able to live. In Judaism, we have another kind of “photosynthesis,” which occurs not in plants, but within our precious children. The children receive the “energy” from the Torah, and with this spiritual force they produce our “oxygen” – the key to our survival. When we send our children off to school to learn Torah, we are doing our part to produce our nation’s “oxygen,” ensuring our continued existence.

Torah study is the ammunition we need to fight the Satan. The more we invest in Torah education, the more successful we will be in this ongoing battle, and ensure that Kedusha will prevail and triumph over evil.

B"H - It has swimming-pool style large steps at the stern, so if you jump into the water at the bow and swim around the boat, you can comfortably climb out and repeat the operation as many times as you want, until you get tired or fed up, whichever comes first. The deck also looks spacious enough to hang out the laundry to dry, which is a plus, if you think about it and consider the quality of life on board. The appointment of the two comfortable deck chairs on the top of the tower for him & her are also a nice innovation that we haven not seen elsewhere and they certainly transmit a sense of relax and a promise of unforgetable sun-set views in a most romantic of settings. The only thing I don't like about this boat is the color. I wonder if they have it in white & blue? If they did, I'd buy one straight away, local laws permitting.

- Thank you for your interest in Torah and the problems "settlers" are facing. As I don't know you I googled your email address and did not find any reference of you being Jewish. As far as your Jewish Yisrael membership is concerned this is a problem, because according to Torah only Jews can contribute to the development of the history of Israel, which is the declared goal of the group.

Having said that let me point out to you that the original project of the mailing-list is now largely overtaken by the event of the blogsphere and you are welcome to follow http://www.thetorahrevolution.blogspot.com.

The basic idea is that Torah is the G-d given Constitution of the Jews and that it gives us specific instructions also on what institutions to establish on the Land and on how to run them.

Having this in mind it is clear that the present State of Israel is not what is required from the Jewish people to strive for and to support and so the political horizon is to at least abstain from the vote.

30 plus per cent of Israelis already do this, so even if we are not a homogeneous group, we don’t start from scratch: Non voters are in fact the biggest slice on the cake-chart and the highest column on the bar-chart. So, we should make our alternative voice be heard.

It has been said that only what we think of as possible is possible. I think our job today is to make Torah seen by the Jews as a possibility: That it is not something to contemplate just in the synagogue, but rather a full time life experience, a project to implement around the clock, 24/7.

Well, there are a few problems with this:

a) I'm not sure it is so. Are you?

b) Even if it was so, what difference would it make? Are we going by numbers or by truth?

c) Torah teaches us that we are to dwell alone (Num.23:9) Longing for international support is, per definition, an anti-Torah, erev rav mentality. Jews refer to Torah and trace their rights, one of which is to the Land, and duties to G-d.

With other words, Jews (supposed to) have a "Hashemist" enterprise, not a Zionist one and that is precisely why xtians should not be allowed in, even if they "love us".

Their “love” of us does NOT mean they love Hashem. In fact, by the very fact that they see it fit to worship yeshu, even if in conjunction with Hashem, makes them idol worshipers (Rambam, Hilichot Avoda Zara, chapter two, halacha one).
